Terms of Service

These Terms of Service ("Terms") govern your use of Kova ("we", "our", "us") at kova.app. By using Kova, you agree to these Terms. If you do not agree, do not use the service.

1. Eligibility

You must be at least 18 years old to use Kova. By creating an account, you confirm that you are 18 or older and have the legal capacity to enter into these Terms.

2. Account Responsibilities

You are responsible for maintaining the security of your account credentials.
You are responsible for all activity that occurs under your account.
You must provide accurate information when creating your account.
You must notify us immediately if you suspect unauthorized access to your account.

3. Acceptable Use

You agree to use Kova only for lawful purposes. You must not:

Violate any applicable laws or regulations, including but not limited to the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and state-level telemarketing laws
Make calls to numbers on the National Do Not Call Registry unless you have an existing business relationship or prior express consent
Send unsolicited commercial emails that do not comply with CAN-SPAM requirements
Misrepresent your identity or affiliation when contacting leads
Use the platform to harass, threaten, or abuse any person
Attempt to access, scrape, or extract data from Kova in any automated manner
Reverse engineer, decompile, or disassemble any part of the service
Use the service to compete with Kova or build a competing product
Share your account or resell access to the service

4. Cold Calling Compliance

Kova provides tools for sales outreach. You are solely responsible for complying with all telemarketing laws, including:

TCPA - You must comply with the Telephone Consumer Protection Act, including restrictions on autodialed calls, prerecorded messages, and calling hours (no calls before 8 AM or after 9 PM local time of the person being called)
Do Not Call - You must check and honor the National Do Not Call Registry and maintain your own internal do-not-call list
State Laws - Many states have additional telemarketing regulations. You are responsible for knowing and following the laws in every state where you place calls
Caller ID - You must transmit accurate caller ID information

Kova does not make calls on your behalf. You initiate all calls manually. Kova is a tool; how you use it is your responsibility.

5. Email Compliance

When using Kova's AI email features, you are responsible for complying with the CAN-SPAM Act and applicable email laws:

Do not use false or misleading header information
Do not use deceptive subject lines
Identify your messages as advertisements where required
Include your valid physical postal address
Honor opt-out requests within 10 business days
Monitor what others do on your behalf

6. AI-Generated Content

Kova uses AI (powered by Anthropic's Claude) to generate call scripts, emails, objection responses, lead insights, and coaching. You acknowledge that:

AI-generated content is provided as suggestions only
You are responsible for reviewing and editing all AI content before use
AI-generated insights, scores, and estimates are approximations, not guarantees
We do not guarantee the accuracy, completeness, or suitability of AI outputs
You should not rely solely on AI-generated information for business decisions

7. Lead Data

Kova's lead finder retrieves publicly available business information from Google Maps. This data is provided by Google and subject to Google's terms. We do not guarantee the accuracy of lead data including phone numbers, ratings, websites, or business status.

8. Subscriptions and Payments

Kova offers free and paid subscription plans
Paid plans are billed monthly or yearly through Stripe
You authorize recurring charges for your selected plan
Prices may change with 30 days notice
You can cancel your subscription at any time from your account settings
Cancellation takes effect at the end of your current billing period
We do not offer refunds for partial billing periods

9. Free Plan Limits

The free plan includes limited calls, searches, and AI messages per month. We reserve the right to modify free plan limits at any time.

10. Affiliate Program

If you participate in Kova's affiliate program:

You must disclose your affiliate relationship in all promotional content as required by FTC guidelines
You must not make false or misleading claims about Kova
You must not use spam, deceptive advertising, or any unethical promotion methods
We reserve the right to terminate affiliate accounts that violate these terms
Commission rates and payment terms are specified in the affiliate dashboard

11. Intellectual Property

Kova and its original content, features, and functionality are owned by Kova and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the service.

12. Disclaimer of Warranties

Kova is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, secure, or error-free.

13. Limitation of Liability

To the maximum extent permitted by law, Kova and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

14. Indemnification

You agree to indemnify and hold harmless Kova and its owners, employees, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the service, your violation of these Terms, or your violation of any law or regulation (including telemarketing and email laws).

15. Termination

We may suspend or terminate your account at any time for violation of these Terms, without prior notice. Upon termination, your right to use the service ceases immediately. Sections on liability, indemnification, and intellectual property survive termination.

16. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules, unless you qualify for small claims court.

17. Changes to Terms

We may update these Terms from time to time. Continued use of Kova after changes constitutes acceptance of the new Terms. We will notify you of significant changes by posting the updated Terms on this page.
